RubyCollect Terms of Service

Updated October 22, 2026. These terms govern use of rubycollect.ca and its collection, listing, messaging and marketplace features. RubyCollect is an online intermediary for independent collectors and stores, not the manufacturer or issuer of cards. Contact: support@rubycollect.ca.

1. Accounts and eligibility

Provide accurate information, protect your credentials, verify your email when required, and use only accounts you are authorized to control. RubyCollect is available only to individuals aged 18 or older. Minors may not create accounts, browse or participate in its marketplace, even with parental permission. We require age confirmation at registration and for existing members, may request additional identity or age verification when lawful and proportionate, and may suspend access for false declarations, fraud, security or policy breaches, subject to applicable consumer rights.

2. Collections and visibility

Personal collections are private by default. You can choose to make a collection public, exposing the card details you select and enabling inquiries. Public collection inquiries and offers are expressions of interest, not completed sales or binding purchases. Do not publish addresses, phone numbers, payment credentials or sensitive information in card descriptions or messages. Free accounts currently support up to 15 collection cards; expanded collection storage, if purchased, is a separate subscription from marketplace Premium.

3. Listings and seller obligations

Sellers are responsible for lawful ownership, authenticity, accurate condition descriptions, photos, pricing, shipping terms, applicable taxes and fulfillment. Do not list counterfeits, stolen goods, prohibited items or cards you cannot deliver. Sellers must provide required listing evidence and cooperate with verification and disputes. RubyCollect may review, restrict or remove suspicious listings, but verification and video evidence do not guarantee authenticity or delivery.

4. Physical cards and E-Pack transactions

Physical-card sellers must provide the required pre-listing proof video where the workflow requires it. Buyers should preserve packaging and record unboxing evidence for a claim. An absent video may affect what evidence is available, but does not automatically eliminate statutory rights, card-network rights or remedies under applicable law. For E-Pack listings, buyers must supply the correct account username; sellers must complete the transfer and provide the required timestamped trade evidence. E-Pack transactions are subject to the platform's acceptance, review and dispute process. RubyCollect is independent of Upper Deck, Topps, Fanatics and other card manufacturers unless an explicit partnership is announced.

5. Prices, fees and Quebec

Standard seller fees are currently 6% for physical cards and 7% for E-Pack cards; marketplace Premium seller fees are 4% and 5%. Minimum seller fees scale with low card prices, starting at CAD $0.50 and reaching up to CAD $0.79 Standard or CAD $0.69 Premium. Marketplace commission for physical cards and E-Pack applies only to the card price, excluding shipping and sales tax. For physical cards, RubyCollect separately deducts 2.9% of buyer-paid shipping to recover the domestic-card percentage processing cost, without adding a second fixed transaction fee or commission on shipping. This recovery is a standard-rate estimate of payment processing costs and can differ from actual processor charges by payment method. It is part of the disclosed seller deduction, not an additional buyer surcharge. Seller fees are calculated and disclosed before payment and are locked into the order. Previously placed orders keep their original fee terms. Standard buyers outside Quebec currently pay a 1% RubyCollect Buyer Protection fee capped at CAD $10 per order; eligible Premium buyers outside Quebec have that fee waived. For Quebec buyers, RubyCollect currently applies a 3% mandatory regional Buyer Protection platform fee to the card price for Standard and Premium buyers, regardless of payment method. This is a RubyCollect platform charge, not a government tax, not an insurance policy, and not an extra fee imposed for using a credit or debit card. The applicable mandatory fee is included in the prominently displayed advertised card price for the buyer's selected region, and its component amount is identified in the checkout breakdown. A CAD $100 card therefore displays as CAD $103 to a Quebec buyer before applicable taxes and separately identified delivery costs. The saved checkout address determines the final region and may update the price before the buyer authorizes payment. Any difference must be disclosed before payment and the buyer may decline the purchase. We do not impose a separate credit-card surcharge on Quebec transactions. Other optional services, shipping and legally applicable taxes are disclosed before payment. Prices and fees may change prospectively with notice; the applicable amount is confirmed before purchase. Marketplace Premium is currently CAD $9.99 monthly or CAD $99.99 annually, plus applicable tax. Separate collection storage subscriptions, if offered, are not included in that price.

6. Taxes and checkout

Applicable GST, HST, PST and QST are separate from RubyCollect's platform fee and are assessed according to the transaction, tax registrations, seller status and applicable law. RubyCollect may collect and remit taxes where required; sellers remain responsible for their own tax reporting and obligations where applicable. RubyCollect may prevent payment when tax treatment or seller payout verification is incomplete. Payment processing and connected-seller payouts are provided by Stripe; additional provider terms may apply. Display-currency conversions are estimates unless expressly confirmed as the final settlement currency.

7. Orders, disputes and refunds

Payments may be held pending transaction verification, acceptance or dispute review. Buyers and sellers must submit accurate evidence and cooperate promptly. RubyCollect may investigate, delay transfers, refund or reverse transactions where permitted and appropriate. For physical-card return and refund eligibility, see our Returns & Refunds Policy. Refund eligibility depends on the circumstances, applicable law and payment-provider rules. Nothing in these terms excludes non-waivable consumer protection rights, chargeback rights or legal remedies. Shipping estimates are estimates, not guarantees.

8. Memberships and subscriptions

Paid plans renew on the disclosed billing cycle until cancelled according to the applicable subscription terms and law. The price, renewal period and cancellation process must be shown before enrollment. Cancelling generally stops future renewals; statutory cancellation and refund rights remain unaffected. Marketplace Premium and expanded My Collection storage are distinct products.

9. User content and intellectual property

You retain your rights in original content and grant RubyCollect a non-exclusive licence to host, display, process, resize, review and retain it to provide and secure the service and, for content you deliberately make public, to display it within the marketplace. You must have the rights needed to upload it. RubyCollect branding, site software and original design remain protected by applicable intellectual-property law. Third-party marks belong to their owners; no affiliation is implied.

10. Safety, moderation and records

Do not harass, scam, manipulate evidence, scrape private data, circumvent security, or use the service unlawfully. We may restrict access and retain necessary transaction, fraud-prevention and moderation records after an account is removed, where justified and legally permitted. Removed accounts are hidden from the active member administration list but may remain in restricted audit records.

11. Service availability and liability

Features may be in testing or temporarily unavailable. We do not guarantee uninterrupted availability, third-party delivery or the value of collectible cards. To the maximum extent permitted by applicable law, RubyCollect is not responsible for losses outside its reasonable control. Nothing here excludes liability or warranties that cannot lawfully be excluded, including rights under Quebec consumer law.

12. Privacy, changes and governing law

Our Privacy Policy describes personal-information handling. Material changes to these terms will be communicated as required by law and will not retroactively override completed purchase terms or mandatory rights. These terms are governed by applicable Canadian and Ontario law, without depriving consumers of mandatory protections in their province of residence. For support, complaints or legal notices email support@rubycollect.ca.

These terms describe current intended operation and should receive a final Canadian/Quebec legal review before unrestricted paid marketplace launch.
